Waste, liquid and gaseous fuel from waste, waste incineration, recycling, waste recovery

Draft Decree stipulating the conditions under which liquid and gaseous fuel from waste ceases to be waste

The aim of the draft is to define the criteria by which the defined types of waste cease to be waste. The draftdefines these criteria for liquid and gaseous fuel produced from waste. In selected cases, it also allows formaterial recovery.

The possibility to stipulate, at national level, criteria under which waste that has been subject to recycling orother recovery operations may cease to be waste and the essential requirements for such criteria is based onArticle 6 of Directive 2008/98/EC of the European Parliament and of the Council of 19 November 2008 onwaste and repealing certain Directives, as amended by Directive (EU) 2018/851.
The draft aims to simplify the use of fuels from waste in terms of the requirements of the Waste Act and itsimplementing legislation. This simplification should help to divert waste from landfill towards energy recovery.
The requirements are stipulated in such a way that the process does not endanger the environment or humanhealth beyond what is ensured by waste management of these fuels.
