Certain fisheries and aquaculture products

Regulations of the Swedish Agency for Marine and Water Management on the traceability of certainfisheries and aquaculture products HVMFS 2017:14

The regulations contain provisions on the traceability of fishery and aquaculture products which are madeavailable on the Swedish market, and which are or have been physically present on Swedish territory, andwhich fall under Chapter 3 or subheading 1212 21 00 of Chapter 12 of Council Regulation (EEC) No 2658/87of 23 July 1987 on the tariff and statistical nomenclature and on the Common Customs Tariff, with theexception of:

1. fisheries and aquaculture products caught or farmed in freshwater;
2. ornamental fish, crustaceans or molluscs for aquariums; and
3. imported fisheries and aquaculture products which either
a) have been imported into the Union under catch certificates in accordance with Council Regulation (EC) No1005/2008 of 29 September 2008 establishing a Community system to prevent, deter and eliminate illegal,unreported and unregulated fishing, amending Regulations (EEC) No 2847/93,
(EC) No 1936/2001 and (EC) No 601/2004 and repealing Regulations (EC)
No 1093/94 and (EC) No 1447/1999; or
b) are not covered by catch certificates pursuant to Article 12(5) of Council Regulation (EC)
No 1005/2008.
Where a mixed batch contains imported fisheries and aquaculture products, these provisions shall apply to allfisheries and aquaculture products in the batch.
The draft regulations contain various simplifications for companies. The detailing of standards andspecifications for the labelling and digital information sharing between operators has been deleted.
Definitions have been added to increase the clarity of the regulations and, thus, make it easier for companies.Among other things, the concept of ‘transformation’ has been introduced to summarise important measures incompany internal traceability.
The provisions on the submission of information are being amended to reflect the change in the informationsharing model. Current traceability events, and information about these, shall continue to be documented. Thecontinuous submission of information to the Swedish Agency for Marine and Water Management is beingrestricted to only batches of origin, i.e. information on the first placing on the market of the fisheries oraquaculture products concerned. Other information on traceability events involving external traceabilitybetween operators and internal traceability within a company must be submitted to the Agency upon request inthe prescribed manner. A time limit for how long the information needs to be kept in order to be available uponrequest, is being introduced.
The provisions on the labelling and information to accompany deliveries are being amended. The nationalrestrictions on labelling are deleted to allow for all methods possible under Article 67 of Regulation (EU) No404/2011. Provisions are introduced for the labelling of batches which, on delivery, are stored in a tank, orsimilar, where the identification number cannot be affixed to the batch in the way indicated by the EU.
The requirement for specific batch labelling of catches below the minimum conservation reference size isdeleted.
Annex 2 is deleted and the requirements are integrated into the new Annex. The Annex provides aggregatedinformation on the information that is to be submitted or available for each traceability event. Some easing hasbeen introduced in relation to the current requirements.
