The Swedish Post and Telecom Authority’s Regulations on exemptions from the permit requirement for theuse of certain radio transmitters

Under Chapter 3, Section 1 of the Electronic Communications Act (2022:482), a permit is required for theuse of certain radio transmitters or for the use of radio transmitters within a given frequency spectrum. UnderChapter 3, Section 4 of the same Act, the Government, or the authority designated by the Government mayissue regulations on exemptions from the permit requirement under Chapter 3, Section 1. Under Section 26 ofthe Electronic Communications Ordinance (2022:511), the Post and Telecom Authority may issue suchregulations on exemptions from the permit requirement. The draft contains such provisions on exemptionsfrom the permit requirement. In principle, decisions on exemptions are not, in the view of the Post and TelecomAuthority, to be regarded as technical regulations as defined in Section 2(1) of the Technical Rules Ordinance(1994:2029).

The provisions of the attached regulations which the Post and Telecom Authority considers to possibly becovered by the notification obligation under the Technical Rules Ordinance are the provisions on entry-levelcertificates for radio amateurs.
The technical requirements laid down are in line with requirements of EU law. [Theoretically, we could have areciprocity clause, e.g. ‘CE marked or meeting the equivalent requirements as in RED’]
