Royal Decree laying down technical regulations for the operation of the electricity transmission network

The Royal Decree laying down technical regulations for the operation of the electricity transmission networkcontains, in accordance with Article 11 of the Act of 29 April 1999 on the organisation of the electricity market:

1. the technical safety criteria and technical rules laying down the minimum requirements for the technicaldesign, management and operation of generating installations, distribution systems, directly connectedcustomers’ equipment, interconnector circuits and direct lines, to be complied with. Those technical rules areobjective and non-discriminatory;
2. the operational rules to which the network operator is subject in its technical management of electricity flowsand the measures to be taken to deal with problems of overloading, technical deficiencies and defects ofgenerating modules, with the exception of the establishment of the methodology and the conditions laid downin the Code of Conduct for Electricity by the regulator;
3. where appropriate, the priority to be given as far as possible, taking into account the need for security ofsupply, to generating installations using renewable energy sources, or to cogeneration units;
4. the ancillary services to be provided by the network operator, without conditions;
5. the information to be provided by the network operator to the operators of other electricity networks to whichthe transmission network is connected in order to ensure secure and efficient operation, coordinateddevelopment and interoperability of the interconnected network, with the exception of the establishment of themethodology and the conditions provided for in the Code of Conduct for Electricity determined by the regulator;
6. the provisions on information obligations relevant under this section applicable to the network operator and,where applicable, to the network user;
7. the circumstances under which the Commission may decide that the power-generating module, theconsumer installation, the installation of a distribution network connected to a transmission network, thedistribution network connected to the transmission network, the HVDC system or DC-connected power parkmodule on the transmission network, as referred to by the European Network Code RfG, the EuropeanNetwork Code DCC and the European Network Code HVDC, shall be regarded as existing or new for thepurposes of these European Network Codes and the technical regulations;
8. the provisions for prior approval of the system protection plan, the restoration plan and the test plan, as wellas the elements to be included in those plans, without prejudice to the elements to be included therein inapplication of the European Network Code E&R; these plans include, inter alia, the methodology for sizing theneeds for system protection services and restoration services, as well as those for determining the means tomeet these needs;
9. the elements to be included in the risk-preparedness plan without prejudice to the elements to be includedtherein in application of Regulation (EU) 2019/941.

Approval is also given via this Royal Decree to:
1. the maximum capacity thresholds applicable to types A, B, C and D power-generating modules inaccordance with Article 5(3) of the European Network Code RfG (EU) 2016/631;
2. the requirements of general application.
In the technical regulations referred to in paragraph 1, the King shall designate the competent authorityreferred to in Article 3 of Regulation (EU) 2019/941.

- Commission Regulation (EU) 2017/1485 of 2 August 2017 establishing a guideline on electricity transmissionsystem operation;
- Commission Regulation (EU) 2017/2195 of 23 November 2017 establishing a guideline on electricitybalancing;
- Commission Regulation (EU) 2017/2196 of 24 November 2017 establishing a network code on electricityemergency and restoration;
- Regulation (EU) 2019/941 of the European Parliament and of the Council of 5 June 2019 on risk-preparedness in the electricity sector and repealing Directive 2005/89/EC.
