Draft Act amending Act LXVI of 2022 on the protection of origin of agricultural products

Apart from the exceptions specified, pursuant to the provisions of the draft Act, the protected geographicalindication may appear on the packaging of an agricultural product bearing the trader’s own brand name ortrademark, only if the final sales packaging contains the name and address of the economic operatorproducing the product designated by the geographical indication. and this entity is entitled to determine theappearance and name of the agricultural product or the essential content of its labelling and is authorised tosell the product without restriction by any means of his own choice.

Sales by undertakings that operate in the sectors specified in the decree implementing the Act, as well asagricultural products placed on the market in quantities not exceeding 1 000 units of packaging, are exceptionsfrom this provision.
Products which do not comply with the new requirements to be introduced by the amendment of the Act andwhich were already on the market on the date of entry into force of the provision (that is, on 1 July 2025), mayremain on the market.
