Conducting the process of mechanical-biological treatment of unsorted (mixed) municipal waste

Draft Regulation of the Minister for Climate and the Environment amending the Regulation on mechanical-biological treatment of unsorted (mixed) municipal waste

The draft Regulation amends the Regulation of the Minister for Climate and the Environment of28 December 2022 on the mechanical-biological treatment of unsegregated (mixed) municipal waste (Journalof Laws of 2023, item 56) issued on the basis of the authorisation provided for in Article 33(3) of the Waste Actof 14 December 2012 (Journal of Laws of 2022, item 699, as amended). The Regulation introduces, inter alia,the following amendments to the existing Regulation on the mechanical-biological treatment:

— reference to the concept of ‘building’ as defined by the Construction Law was abandoned and it wasproposed that the unloading and mechanical processing of non-segregated (mixed) municipal waste should becarried out in a building facility, as defined by the Construction Law, which is closed;
— amendments in the scope of the size of the so-called ‘sub-sieve fraction’ have been introduced withreference to the term of ‘sieve’ in conjunction with its size — the sub-sieve fraction shall include a fractionseparated on a sieve with a mesh size not exceeding 100 mm;
— amendments have been introduced with a view to open up a catalogue of waste which can be generated byunsegregated (mixed) municipal waste subjected to the mechanical waste treatment process;
— amendments have been introduced in the scope of biological treatment of the sub-sieve fraction waste withreference to treatment under aerobic and anaerobic conditions;
— amendments have been introduced in the scope of sampling and testing the stabilised fraction.
